This comprehensive legislation has successfully passed both its first and second readings and is currently in the committee stage in the House of Commons. Designed to modernise Canada's approach to privacy protection and artificial intelligence (AI) regulation, Bill C-27 aligns the country with international standards and addresses emerging challenges in the digital age. The Act encompasses three major components:


1. Consumer Privacy Protection Act (CPPA)

2. Personal Information and Data Protection Tribunal Act

3. Artificial Intelligence and Data Act (AIDA)


1. Understanding Bill C-27


Consumer Privacy Protection Act (CPPA) aims to enhance the protection of personal information and ensure robust privacy standards. It introduces new requirements for obtaining consent, mandates transparency in data collection, and grants individuals more control over their personal data.


Personal Information and Data Protection Tribunal Act establishes a tribunal to address disputes related to privacy and data protection, providing a faster and more efficient means of resolving such issues.


Artificial Intelligence and Data Act (AIDA) is the core component addressing AI regulation, ensuring that AI systems used within Canada are safe, transparent, and accountable.


2. The Core of the Artificial Intelligence and Data Act (AIDA)


AIDA is poised to be one of the first comprehensive legislative frameworks in the world dedicated to regulating AI. It sets out to ensure that AI systems used within Canada are safe, transparent, and accountable. Here are the key elements of AIDA:


Risk-Based Regulation: AIDA introduces a risk-based approach to regulating AI systems, particularly those deemed "high-impact." These include AI systems used in employment decisions, biometric data processing, law enforcement, and more. The legislation mandates rigorous risk assessments, the implementation of mitigation measures, and continuous monitoring to ensure these systems do not cause harm or perpetuate bias. Section 7 of AIDA states, "Every person who is responsible for a high-impact system must conduct an assessment to determine whether the system, when used, causes or is likely to cause material harm."


Transparency and Accountability: Organisations deploying high-impact AI systems are required to maintain detailed records, publish descriptions of their AI systems, and notify authorities of any material harms caused by these systems. This transparency is crucial for building public trust and ensuring that AI systems are used responsibly. Section 11 mandates, "A person who makes a high-impact system available for use must, in accordance with the regulations, publish on their website a plain language description of the system."


Ministerial Oversight: The Minister of Innovation, Science, and Industry is granted significant oversight powers under AIDA. These include the ability to request information, conduct audits, and enforce compliance. This ensures that regulatory oversight keeps pace with the rapid evolution of AI technology. According to Section 15, "The Minister may, by order, require a person to provide any information or records necessary to verify compliance with this Act."


Penalties and Offences: AIDA establishes clear penalties for non-compliance, including substantial fines and criminal charges for severe violations. This robust enforcement mechanism is designed to deter misuse and ensure adherence to the law. Section 29 states, "A person who contravenes any provision of sections 6 to 12 is guilty of an offence and liable on conviction on indictment to a fine not exceeding $10,000,000."


3. Comparisons with the EU AI Act


The EU Artificial Intelligence Act (EU AIA), passed by the European Parliament in July 2024, also aims to regulate AI comprehensively but follows a slightly different approach:


1. Risk Classification: The EU AIA classifies AI systems into four categories: unacceptable risk, high-risk, limited risk, and minimal risk. Unacceptable risk AI systems, such as social scoring and manipulative AI, are outright banned. High-risk AI systems, like those used in critical infrastructure and law enforcement, are subject to stringent requirements. Limited risk AI systems must meet transparency obligations, while minimal risk systems face no regulation. In contrast, AIDA focuses primarily on high-impact systems but does not employ a tiered risk classification.


2. Transparency and Documentation: Both AIDA and the EU AIA mandate transparency and detailed documentation for high-risk or high-impact AI systems. However, the EU AIA extends this requirement to general-purpose AI (GPAI) systems that may not be immediately classified as high-risk but have the potential to be integrated into high-risk applications. This includes requirements for technical documentation, data governance, and cybersecurity measures.


3. Governance and Oversight: The EU AIA establishes the European Artificial Intelligence Board (EAIB) to oversee compliance and support innovation, while AIDA places significant oversight responsibilities on the Minister of Innovation, Science, and Industry. The EAIB will support the development of AI literacy and public awareness, promoting ethical AI use across the Union.


4. Penalties and Enforcement: Both regulatory frameworks impose substantial penalties for non-compliance. The EU AIA includes fines up to 6% of global annual turnover for severe breaches, whereas AIDA sets fines up to $10 million or 3% of global revenue.


5. International Reach: The EU AIA applies not only to AI systems developed within the EU but also to those developed outside the EU if their output is used within the Union. This extraterritorial application ensures that AI systems impacting EU residents comply with its regulations. AIDA primarily focuses on systems developed and deployed within Canada but could be interpreted to cover international systems impacting Canadian users.


4. Generative AI Code of Conduct


In addition to the regulatory framework established by AIDA, the Canadian government introduced the Generative AI Code of Conduct in September 2023. This voluntary code aims to promote the responsible development and management of advanced generative AI systems. Key aspects of the code include:

  • Temporary Voluntary Measures: The Code of Conduct provides temporary measures for businesses to commit to, ensuring responsible AI practices are in place ahead of the full enactment of AIDA.

  • Proactive Measures: It identifies measures that businesses should apply in advance of the AI and Data Act being passed, promoting early adoption of best practices.

  • Broad Support: As of now, 23 organizations have signed the Code of Conduct, reflecting broad industry support for responsible AI development.


5. Directive on Automated Decision-Making


Furthermore, Canada has established the Directive on Automated Decision-Making, which took effect in April 2019. This directive focuses on automated systems and algorithms used to make administrative decisions. Key requirements of the directive include:

  • Algorithmic Impact Assessments: Organisations must conduct assessments to evaluate the impact of their automated decision-making systems.

  • Transparency and Notice: Transparency and notice must be provided to impacted parties, ensuring individuals are aware of and understand the decisions affecting them.

  • Ongoing Monitoring and Quality Assurance: Continuous monitoring, testing, and quality assurance measures are required to maintain the integrity and reliability of automated systems.


6. Potential Impacts on AI Developers and Deployers


For AI developers and deployers, AIDA represents both a challenge and an opportunity. Here are some key insights into its likely impact:


- Enhanced Compliance Requirements: Developers will need to incorporate rigorous risk assessment and mitigation processes into their AI development cycles. This may increase development costs and timelines but will ultimately result in safer and more trustworthy AI systems.


- Transparency and Public Trust: By mandating transparency and public disclosure, AIDA aims to build public trust in AI technologies. Organisations that prioritise ethical AI practices will likely benefit from increased consumer confidence and a stronger market position.


- Innovation and Competitive Advantage: Aligning with international AI governance frameworks can provide Canadian AI firms with a competitive advantage in global markets. By adhering to high standards, Canadian AI products and services can be more easily adopted and trusted internationally.


- Legal and Financial Risks: Non-compliance with AIDA could result in significant legal and financial repercussions. Organisations must invest in robust compliance programs to avoid these risks and ensure they meet all regulatory requirements.
